Access to the court file was granted because, on balancing Rule 12 factors, the privacy and confidentiality interests were minimal given the passage of over 70 years and the death of directly involved persons, and although Rule 7 applies to proceedings under the Marriage Act 1908, that factor did not outweigh the significant public and personal interest in researching family history.
