The adjudication was annulled because Ms Li was already bankrupt when Windward obtained its adjudication, the debt relied on was a provable debt in the extant bankruptcy, these true facts were not before the Court at the time of adjudication and would have affected the outcome, therefore annulment under s 309(1)(a) was required.
