Leave to appeal was declined because the High Court's findings were fact specific and there was no question of law of sufficient general importance: ACC's dual retrospective decision triggered statutory vocational rehabilitation obligations which it failed to follow, and the s105(2) termination relied on inadequate retrospective medical evidence; although s105(2) determinations may be made without vocational assessments in cases where recovery precedes the rehabilitation trigger, that was not this case.
