The appeal is dismissed because the weight of the evidence establishes that the appellant's recurring pain is probably caused wholly or substantially by an underlying degenerative spinal condition rather than by unresolved effects of the 1996 injuries; prior adjudication (Shann (123/04)) and the medical opinion that there is no chronic pain syndrome preclude entitlement.
