Section 65(3)(f) terminates a restraining order upon refusal of a confiscation/forfeiture order and Parliament did not intend ss 39–43 to be used to re‑impose a restraining order after such termination; therefore the Court must dismiss the Crown's application for a fresh restraining order pending appeal and any legislative gap must be addressed by Parliament.
