The review is dismissed because the further evidence does not supply the necessary cogent factual foundation that GFG was involved in preparing the Fact Sheets, knew of the plaintiffs or foresaw their reliance; on the material before the Court plaintiffs did not have a good arguable case and therefore jurisdiction under r131/r219 could not be assumed; admission of the Warburton evidence would not alter that conclusion.
