The court held that Dr Luke, as the requesting clinician, had a responsibility to obtain and note the formal radiologist report on the chest x-ray he ordered; his failure to do so and to act on that report was an omission below the standard of care reasonably to be expected and therefore constituted medical error, and that omission contributed to the delayed diagnosis.
