The Environment Court did not commit an error of law: it had sufficient information and expert evidence to assess the effects of the proposed earthworks; final detailed engineering design can legitimately be required by condition and provided post-consent (and checked under the Building Act 2004); the conditions imposed did not amount to unlawful delegation of RMA decision-making; accordingly the High Court dismissed the appeal.
