Because the Employment Relations Act allocates exclusive jurisdiction to the Employment Court for employment relationship problems and the High Court retains jurisdiction for non‑employment causes of action, commencing High Court proceedings based on distinct causes of action (even if factually overlapping) was not an abuse of process; potential for double recovery or issue estoppel is managed by ordinary doctrines and can be resolved after the Employment Court decision, so strike‑out was premature and the stay ordered by Ellis J was appropriate.
