Contemporaneous financial records and Inland Revenue returns established the partnership operated at a loss and the appellant had no earnings as a self-employed person immediately before incapacity; contemporaneous notes showed he worked part-time (<30 hours/week) and was not liable for the minimum levy; therefore s14 yields nil earnings and clauses 38 and 42 of Schedule 1 do not apply, entitling ACC to decline weekly compensation—appeal dismissed.
