The appellant ceased to be an earner on 13 July 2010 and her incapacity commenced on 13 August 2010, which is 31 days later and therefore outside the 28 day deeming period in Clause 43(2); accordingly she was not an earner 'immediately before' incapacity for purposes of Clause 32 and is not entitled to weekly compensation.
