The claimant failed to prove causation because the expert opinions relied upon were based on materially inaccurate exposure histories (substantially overstated duration of pelting work) and the long delay between exposure and claim undermined the causal link; additionally the claimant failed to satisfy the s33(2)(c) significantly greater risk test, therefore the claim for cover under s33 must be dismissed.
