The parties expressly agreed that the expert's determinations would be fully and finally binding and that no further court proceedings would be pursued except to enforce the expert's decision; that contractual bar prevents Marquis from reviving court proceedings on the fiduciary claim and thus Marquis's application for summary judgment against Mr Lorenzen was dismissed, while summary judgment was granted on the amounts previously determined in favour of Ray's Construction and by Lorenzen against the Kemps; remaining omitted issue to be referred back to the expert by the parties.
