There was a bona fide and demonstrable dispute about defects, remedial work and set off such that the Court correctly refused summary judgment; where an arbitration agreement exists and a genuine dispute is shown the court must stay proceedings and refer the matter to arbitration, so the appeal is dismissed and the stay and referral ordered upheld.
