On the medical record the court accepted the opinions of Dr Dryson and Mr Lyon that deterioration (notably subluxation/instability and worsening sciatic symptoms) had occurred by February 2005; accordingly the correct commencement date for backdated weekly compensation is 1 February 2005 and the appellant is entitled to payments from that date.
