The only expert medical evidence established that the tinnitus was due to the appellant's underlying chronic ear perforation and hearing loss and that epilepsy could not have been caused by the ear operations; therefore there was no proof of a physical injury caused by treatment and no question of law arose under s162 to permit appeal, so leave to appeal is refused.
