The Court held the Complaints Officer erred in construing the complaint's scope and in imputing to the practitioner an intention contrary to his explicit words without properly considering his explanation; those flawed findings underpinned unsustainable conclusions of breach of rr 2.3 and 13.8, so the LCRO and High Court decisions were quashed and the Standards Committee determination reinstated.
