Although the applicants had a position to preserve and an arguable case, interim relief was declined because ministerial decisions prioritising citizens/residents/visa-holders had been made, evacuation operations were effectively closed making orders ineffective, and it would be inappropriate for the Court to order visa issuance or substitute its judgment for executive choices in the emergency context.
