Medical opinions were ambiguous but, on balance, the evidence established that both accident-related articular damage and pre-existing degenerative change together were substantial and effective causes of the appellant's ongoing incapacity; the respondent therefore did not have a sufficient evidential basis under s117 to suspend entitlements and the suspension decision of 8 November 2006 was set aside.
