Judge Ongley held that on the evidence before the Court there was no evidential foundation showing the covered sensitive claim had ongoing consequences that affected capacity to sustain the four identified work‑types; therefore the omission to provide specific sensitive‑claim information to the assessor did not call into question the medical assessment outcome and did not warrant setting the assessment aside; accordingly leave to appeal was granted to address unresolved legal questions but the District Court's factual findings were supportable.
