The High Court held the Tribunal erred in law and fact by declining to determine which policy applied and the construction of the exclusion; evidence established AMP Business Pack policy HO BIP 0600831 (2/97) applied and its exclusion for building/construction works over $100,000 excluded the $1.5m John Jennings complex; s11 Insurance Law Reform Act 1977 did not apply to defeat the exclusion; accordingly the Tribunal removal decision was set aside and Vero was ordered removed from the Tribunal proceeding.
