On the only credible medico-legal evidence before the Court (Mr Packer) and on the balance of probabilities the appellant's incapacitating condition was in material respects caused by complications of the 2004 abdominal surgery; a contributing causal link suffices for entitlement, therefore the respondent's decision was quashed and weekly compensation must be resumed from the date of further incapacity.
