The Court was satisfied the statutory preconditions of s.246 were met: a liquidation application by the Commissioner existed, there was a prima facie case of insolvency, imminent risk to the company's principal asset from landlord action if the business closed, urgency and an undertaking as to damages were present; accordingly interim liquidators were appointed to preserve assets and protect creditors.
