No exceptional circumstances existed: applicant's conduct was not 'quite out of the ordinary', he had a genuine albeit unsuccessful belief, respondent and third parties shared responsibility for lack of documentation, procedural compliance was high, and therefore no order for costs against the legally‑aided applicant was made; under s 45(5) the court records a hypothetical costs liability of NZD 11,393.
