On the balance of probabilities the required surgery was substantially caused by the accident of 25 November 2007; the trial judge preferred the evidence of the operating surgeon who had examined the patient and the file-review surgeon over the Clinical Advisory Panel's view, and therefore the appellant's need for surgery is covered by the Act and the appeal is allowed.
