The Court found there is a serious question to be tried on whether the management agreement confers an exclusive right to QMS; on balance of convenience and having regard to the interests of all proprietors a single on-site manager is preferable and damages may be difficult to quantify, therefore an interim injunction should be granted to preserve the status quo and protect proprietors and QMS pending trial.
