The contractual obligations (retainer, profit share and exclusivity plus commission entitlement) formed an integrated reciprocal package such that the respondent's unliquidated cross-claim for breach of exclusivity and account of profits was interdependent with the appellants' commission claim; consequently it would be inequitable to grant summary judgment without accounting for the cross-claim, and the appeal against refusal of summary judgment is dismissed.
