The defendant is an unlawful occupier under r 13.1, has no arguable defence on the evidence (no affidavit evidence and defences raised were irrelevant or unsupported), and therefore summary judgment for vacant possession is granted to the plaintiff, with costs to the plaintiff on a 2B basis.

The court granted interim directions approving the proposed sale process subject to formal consents: the applicant must file within 28 days a memorandum annexing a draft consent order and executed consents from served beneficiaries or witnessed signatures; the court will not compel addition of Te Waru Hill as beneficiary but will deliver a copy of the judgment to him and encouraged resolution; a short conference will be allocated in early May to finalise consent orders, thereby permitting sale and distribution if required consents are produced.
