There were serious issues to be tried about the lawfulness of the retrospective exemption and whether the Commission complied with statutory requirements; respondents did not oppose interim relief and adequate protections could be fashioned to prevent irreparable harm to other retailers, therefore an interlocutory order restraining payment and preserving disputed funds pending resolution was justified.
