The court granted leave to amend the statement of claim and to replace the plaintiffs' experts' briefs because the interests of justice required that the real controversy go to trial on up-to-date expert evidence; the plaintiffs demonstrated substantial new investigations and evidence and had provided the defendants consolidated briefs with opportunity and sufficient time to respond before the fixed trial date, and any prejudice (including wasted costs) could be addressed by timetable directions and costs orders at trial.
