The Court will consider the basis on which the Attorney-General authorised registration when exercising its discretion under s137 CPRA; where the requesting state's intended basis for forfeiture has materially changed from that before the Attorney-General (conviction-based criminal forfeiture) to civil in rem forfeiture, the Court will not extend registration for a further year on that different basis. However the Court may grant a short limited extension to preserve the applicant's right of appeal.
