Increased costs were justified because the applicant's extension and intended appeal were without merit and involved failure to comply with orders and refusal of a Calderbank offer; NZX as a non-party was entitled to costs; because the same firm acted for both respondents and there was a high probability of overlapping work the Court applied a global discount so total costs awarded were limited to $10,000, split $5,000 each plus disbursements; the applicant's impecuniosity did not justify further reduction.
