The appeal is dismissed except insofar as CVS must file a further affidavit within 14 days specifying the likely time, effort and cost to identify and list documents created between January 2017 and December 2018 relating to treatment of yearling colts with the same symptoms as the colt Adalia and the procedure and difficulties in doing so; affidavits of Mr Lawrence and Ms Woolrich otherwise satisfied discovery requirements and VPI need take no further steps; non-party discovery is constrained by relevance and proportionality and must not be used as a fishing expedition.
