On the balance of probabilities the Subaru was purchased from proceeds of the respondent's drug offences and the BMW was used to facilitate those offences during the relevant period; having considered the s15(2) factors the court exercised its discretion to forfeit both vehicles and ordered payment of the respondent's reasonable legal costs from the restrained property as proportionate and not unduly harsh to third parties.
