The District Court starting point of four years was excessive on the facts; a correct starting point was 3 years 7 months (including one month uplift for driving while disqualified); personal mitigating discounts (including a 5% allowance for Māori systemic deprivation) reduced the sentence to an equivalent of one year nine months imprisonment which is substitutable with nine months home detention; the original imprisonment sentence was quashed and replaced with home detention and specified conditions.
