On the balance of probabilities the evidence does not establish that the appellant's femoral nerve lesion or lateral cutaneous nerve injury were caused by treatment (leaning or equipment pressure) during the 7 March 2012 surgery; contemporaneous records, corrected positioning evidence (supine), specialist opinions and plausible alternative medical causes preclude a robust inference of treatment causation.
