On the balance of probabilities the appellant failed to prove the need for surgery was caused by the 30 July 2011 accident rather than being wholly or substantially caused by pre-existing CAM-type femoroacetabular impingement (a gradual process). The contemporaneous history, imaging, independent medical advice and the Clinical Advisory Panel established that the pathology and surgical procedure principally addressed a developmental impingement process. Accordingly ACC's decision declining funding was correct and the appeal is dismissed.
