    Rowell v Accident Compensation Corporation

    Citation
    [2008] NZACC 119
    Court
    District Court

Independent expert opinion established that tight looping of the umbilical cord causing acute cord compression at delivery was the most likely cause of perinatal asphyxia; monitoring and management by the midwife were within accepted standards and there was no credible expert evidence that any act or omission by the midwife caused or could have prevented the injury; therefore the claim for medical misadventure fails and the appeal is dismissed.
