The Polish order, when read as a whole and in light of unchallenged sworn evidence from a Polish prosecutor, was directed to taking security (restraint) over assets that may be tainted or represent benefits of alleged offending and therefore qualified as a foreign restraining order under the Act; the High Court and Court of Appeal were required to register a qualifying order in force under s56(1); and preliminary appellate comments do not give rise to res judicata or issue estoppel.
