Leave to appeal was refused because there was no real prospect that forensic testing would produce evidence to support the proposed alternative defence, the claim that counsel wrongly prevented the applicant from testifying had been rejected by the Court of Appeal, and proposed neighbour evidence was speculative and unlikely to be cogent; accordingly no substantial miscarriage of justice was shown.
