On the evidence the partially completed will kit, written by the caregiver from the deceased's instructions and read back to him, expressed the deceased's testamentary intentions; s 14 confers a residual remedial discretion which should be exercised to declare the document valid absent cogent evidence of incapacity or undue influence, therefore the Court declared the document to be the deceased's valid will.
