Grove Darlow held confidential information acquired over a long, intensive 12-year retainer (including formation and advice in relation to the Christian-Kells Trust and litigation conduct) that was relevant to the caveat proceedings; there was no consent to disclosure and, given the history and the realistic prospect that recollections may be triggered, there was more than a negligible risk of disclosure; accordingly the firm was restrained from acting in the proceedings to protect the former client's confidences and the integrity of the process.
