Leave under s 76(2) was granted because the claims were not clearly unsustainable, involved fraud convictions and public interest in judicial resolution, were complex and more suitably determined at trial, continuation would not unfairly prejudice the bankruptcy administration given conditions proposed, and plaintiffs consented to a restriction preventing enforcement of any judgment without leave of the Court to preserve the Official Assignee's control.
