Only an allegation of fraud could justify recalling a sealed judgment; the applicant's fraud allegation was raised and rejected in the original judgment and the recall application is an abuse of process and is struck out under the Court's inherent jurisdiction.

Summary judgment was declined because the plaintiff did not provide sufficient evidence—such as the California judge's reasons, transcripts, written submissions or a narrative affidavit—to dispel the defendants' plausible affidavit evidence that no sales occurred and that the US judgment might have been obtained without full disclosure; absent that evidence the court could not be satisfied the defendants had no defence.
