The Court held SCC deliberately engaged in deceptive invoicing practices (duplication via info.nz/ERMS and false additions to ERMS to recoup 'milk run' work) that breached its contractual obligation to deal with Samsung in good faith and constituted a material breach not reasonably capable of remedy within five working days; accordingly Samsung was justified in terminating the agreement and SCC failed the threshold for interlocutory relief, so the injunction was refused.
