Appellant failed to prove on the balance of probabilities that she received the payments in good faith and that she altered her position in reliance on their validity; irregular size and manner of payments and facts about the son’s independence should have put her on inquiry; many transactions either predated payments or occurred after she knew payments were disputed; therefore s251 defence fails and ACC’s decision to decline remission is upheld.
