The Court of Appeal held that the High Court has power to grant interim relief against an overseas defendant before formal service and before determination of any protest to jurisdiction where such relief is necessary to preserve the court's ability to do justice; service and a pending protest are relevant factors in assessing overall interests of justice but do not create a categorical jurisdictional bar; the matter was remitted to the High Court to determine interim relief on notice and on up-to-date facts.
