Sections 121(1) and 80(1) are gateway provisions whose phrase "proved losses" is not limited to pecuniary losses incurred by the injured person; the loss of bodily function that gives rise to the need for attendant care is a compensable loss to the injured person and subs (1) therefore permits ACC, in its discretion, to make payments in recognition of unpaid familial attendant care, subject to case‑by‑case assessment and ACC control.
