The Court refused to strike out Elementary's entire damages claim but struck out parts of paragraph 24 that constituted special damages without adequate particulars (subparas (b) and (e), subpara (d)(ii) and the words "and steps"); dismissed the security application against Mr Ayers personally for lack of sufficient evidence, but exercised its discretion under r 5.45 to order security for costs of NZD 20,000 against Elementary and stayed Elementary's claims pending payment.
