Although on the merits the Judge considered the Registrar would have been correct that the proceeding raised issues of personal importance rather than genuine public interest, the waiver was granted because the applicant had been permitted to commence proceedings, both parties had acted in reliance and significant steps had been taken before the waiver decision was made; the delay precluded recovery of the fee and justified granting the waiver.
